In the matter of the establishment of a branch of Commercial Capital Bank.  Notice is hereby given that the Commercial Capital Bank, whose main office and domicile is located in Delhi, Richland Parish, Louisiana, has made application to the Federal Deposit Insurance Corporation and the Louisiana Commissioner of Financial Institutions to establish a branch to be located at 104 East Parker Street, Hamburg, Arkansas 71646.

Invitation To Bidders

Notice is hereby given by Fleschman’s Bayou Watershed Improvement District of Ashley County, Arkansas, that it will receive bids for cleaning, dredging, ditching, removal of trees and vegetation on site, and spreading of spoil as necessary for maintenance purposes, for that portion of the drainage system as reflected by the attached map, in areas in Township 17, 18, and 19 South, Range 4 West, described as follows:

(a) Main Ditch No. 1- Parts of Lateral 1-C;

(b) Main Ditch No. 1- From Lateral 1-C to Lateral 1-A.

Bids for the required work shall be submitted on an hourly basis for dragline or track hoe of not less than 1.5 yard bucket capacity, with operator, and with such support equipment as required by bidder to enable him to comply with job specifications.

Work will begin at the South end of the drainage system and working upstream or to point of origin or completion. Awards may be made to one or more bidders and for such portion of the above maintenance as permitted by available funds and all contracts will terminate upon utilization of all currently available maintenance funds.

All bidders will be required to provide with their bid evidence of general liability insurance of not less than $1,000,000 coverage and will provide in addition, either evidence of Workers Compensation coverage or a certificate citing statutory authority to the effect that the bidder is not required to maintain such coverage.

Additional information as to specifications, performance time, etc. may be obtained from Bryan A. Hollis, Natural Resources Conservation Service, USDA, Monticello, Arkansas.

Public Notice

The Fountain Hill Waterworks is a public water system subject to regulation under the federal Safe Drinking Water Act. Those regulations require the notification of customers whenever a violation occurs, and is the basis for this notice.

The annual average of quarterly samples of the level of total trihalomethanes, a disinfection by-product, in the water exceeded the maximum contaminant level of 80 parts per billion for the period from October 2020 through December 2020. The average level in your water for site # 016YD008, 016YD009 this period was 99, 88 ppb.

The U.S. Environmental Protection Agency sets national standards for drinking water and has established the maximum level for Total Trihalomethanes at 80 micrograms per liter. Trihalomethanes are a group of by-products chemicals which are formed by the use of chlorine in the treatment of drinking water. Disinfectants, such as chlorine, react with naturally occurring organic and inorganic matter present in water to form chemicals called disinfection byproducts (DBPs). EPA has determined that a number of DBPs are a health concern at certain levels of exposure.

Some people who drink water containing trihalomethanes in excess of the MCL over many years may experience problems with their liver, kidneys, or central nervous system, and may have and an increased risk of getting cancer. EPA has set standards to limit exposure to trihalomethanes, haloacetic acids, and other DBPs.

The Arkansas Department of Health has advised the water system that there is no immediate health risk from consuming the water. Failure to meet this requirement does not mean that the water is unsafe or that alternate sources of water should be used.

The water system has changed out chlorinator and reduced the chlorine residual.

Resolution No. 2021-6

A Resolution Recognizing The Death Of The Honorable Dane Weindorf, Mayor Of Hamburg; Declaring A Vacancy To Exist In The Office Of Mayor Of Hamburg; Calling For Special Election Of Interim Mayor; And Other Purposes

Whereas, the tragic passing of the Honorable Dane Weindorf, Mayor of Hamburg, on February 20, 2021 is respectfully recognized by the City Council of Hamburg, Arkansas;

Whereas, in order to provide for lawful executive administration of the City of Hamburg, the City Council of Hamburg enacts this resolution;

It is, therefore, by the City Council of Hamburg Arkansas, resolved as follows:

1.That a vacancy in the Office of Mayor is declared to exist as of February 20, 2021.

2.That pursuant to ACA 14-43-501(b)(3), if the mayor is unable to perform the duties of office, the City Clerk may perform all functions of a mayor and pursuant to ACA 14-43-304(d) and ACA 14-43-401(b)(2), the City Clerk, being a qualified elector of the City of Hamburg, is appointed to serve as acting Mayor until his successor in office is lawfully elected, qualified and constituted.

3.That Ashley County Arkansas, the County Clerk of Ashley County Arkansas and the Ashley County Arkansas Election Commission are requested to conduct a special election (to be conducted according to law) to fill the vacancy in the office of Mayor for the remainder of the term of the Honorable Dane Weindorf (which expires on December 31, 2022) on the following dates, to wit:

a.Candidates may circulate petitions for candidacy beginning March 18, 2021 at noon with deadline of March 25, 2021 at noon.

b.The drawing for ballot positions will be conducted by the Ashley County Board of Election Commissioners on or before March 31, 2021.

c.The date of the Election will be June 8, 2021 from 7:30 a.m. until 7:30 p.m.

d.Unless a run-off is required, the election shall be certified by the Ashley County Board of Election Commissioners on or before June 23, 2021.

e.In the event a run-off is required the date of the run-off election shall be June 29, 2021 from 7:30 a.m. to 7:30 p.m.

f.If a run-off is required the election shall be certified by the Ashley County Board of Election Commissioners on or before July 13, 2021.

Early Voting for the special election will be conducted in the Ashley County Clerk’s Office, 205 Each Jefferson, Hamburg, Arkansas, beginning Tuesday, June 1, 2021, and continuing through Friday, June 4, 2021, between the hours of 8:00 a.m. and 4:30 p.m., and concluding on Monday, June 7, 2021 between the hours of 8:00 a.m. 4:30 p.m.

Early Voting for the runoff special election, if there is a runoff required, will be conducted in the Ashley County Clerk’s Office, 205 Each Jefferson, Hamburg, Arkansas, beginning Tuesday, June 22, 2021, and continuing through Friday, June 25, 2021, between the hours of 8:00 a.m. and 4:30 p.m., and concluding on Monday, June 28, 2021 between the hours of 8:00 a.m. 4:30 p.m.

All other deadlines and requirements not provided for in this resolution shall be pursuant to Arkansas State law.
