A former Crossett teacher and coach pled guilty to attempted sexual indecency with a child last week.
On Oct. 26 a guilty plea was filed in the Ashley County Circuit Clerk’s office. The plea statement, signed by Rainey, said that he pled guilty to attempted sexual indecency with a child, a misdemeanor, with a maximum punishment of up to 12 months and a fine of up to $2,500.
Rainey was arrested in May after a two-month investigation which, according to the Crossett police, included video evidence. According to a statement from Matt Brooks, an investigator with Crossett Police Department, Rainey was brought in for questioning on May 14 after Arkansas Crimes Against Children notified the CPD that there was alleged inappropriate activity between Rainey and a 17-year-old female student. According to Brooks, Rainey was arrested after the interview.
On June 2, Rainey was officially charged with sexual assault in the second degree. On July 27, Rainey went before Circuit Judge Bynum Gibson for a pre trial and an order was entered giving Rainey until Sept. 28 to accept the plea offer issued by the state.
On Sept. 28 Rainey accepted the plea offer and last week Rainey went before Judge Gibson to enter his plea.
Deputy Prosecutor Frank Spain filed a sentencing recommendation stating that he recommended that Rainey’s sentence be 12 months of unsupervised probation and a fine of $2,500.
Judge Gibson entered an order on Oct. 26 sentencing Rainey to 12 months of unsupervised probation and ordered him to pay a $2,500 fine.
Additionally Rainey was ordered to pay $150 in court costs, a $40 booking fee, a $250 DNA fee, and a $250 sex registration fee.
