The Board of Directors of Hamburg School District of Ashley County, Arkansas, in compliance with the requirements of Amendments No. 40 and No. 74 to the Constitution of the State of Arkansas and of Ark. Code Ann. § 6 13 622, has prepared, approved and hereby makes public the proposed budget of expenditures, together with the tax rate, as follows:

To provide for the foregoing proposed budget of expenditures, the Board of Directors proposes a total school tax rate (state and local) of 39.50 mills on the dollar of the assessed value of taxable property located in this School District.  The proposed tax includes the uniform rate of tax of 25.0 mills (the “Statewide Uniform Rate”) to be collected on all taxable property in the State and remitted to the State Treasurer pursuant to Amendment No. 74 to the Arkansas Constitution to be used solely for maintenance and operation of schools in the State.  As provided in Amendment No. 74, the Statewide Uniform Rate replaces a portion of the existing rate of tax levied by this School District and available for maintenance and operation of schools in this District.  The total proposed school tax levy of 39.50 mills includes 25.0 mills specifically voted for general maintenance and operation, 10.50 mills voted for debt service previously voted as a continuing levy pledged for the retirement of existing bonded indebtedness, and 4.00 new debt service mills.  The 4.00 new debt service mills plus the 10.50 existing debt service mills now pledged for the retirement of existing bonded indebtedness, which debt service mills will continue after retirement of the bonds to which now pledged, will be a continuing debt service tax until the retirement of proposed bonds to be issued in the principal amount of $7,800,000 and which will mature over a period of 32 years and will be issued for the purpose of erecting and equipping new school facilities and making additions and improvements to existing facilities.  The surplus revenues produced each year by the debt service millage may be used by the District for other school purposes.

The total proposed school tax levy of 39.50 mills represents a 4.00 mill increase over the current tax rate.

Ordinance No. 2019-1

An Ordinance Restating The City Of Portland’s Prior Ordinance Fixing The Period Within Which Referendum Petitions May Be Filed; Prescribing Other Matters Relating Thereto; And Declaring An Emergency.

BE IT ORDAINED by the City Council of the City of Portland, Arkansas:

Section 1:  In the late 1950’s, the City of Portland, Arkansas adopted an ordinance, that any referendum petition, under Article 5, Section 1 of the Constitution of the State of Arkansas must be filed with the Clerk within thirty (30) days after the passage of any such ordinance or resolution; and

SECTION 2: The City of Portland has operated thereunder since adoption; and

SECTION 3: All of Portland’s ordinances were destroyed in a casualty loss in early 2000’s and

Section 4: The City of Portland desires to memorialize their practice; and

Section 5: That all referendum petitions under Article 5, Section 1 to the Constitution of the State of Arkansas must be filed with the Clerk within thirty (30) days after the passage of any ordinance or resolution.

SECTION 6: That upon the filing of said referendum petition, the Mayor is hereby directed to give notice by publication for one insertion in a newspaper having a general circulation in the City of Portland and by posting in five (5) public places in the City of Portland of a time not less than five (5) days after the publication of such notice at which the Council will hear all persons who wish to be heard on the question whether such petition is signed by the requisite number of petitioners. At the time named, the Council shall meet and hear all who wish to be heard on the question, and its decision shall be final unless suit is brought in the Circuit Court of Ashley County within thirty (30) days to review its actions.

SECTION 7: That if the Council finds such petition is signed by the requisite number of qualified petitioners, it shall order a special election to determine by a vote of the qualified electors whether the ordinance or resolution shall stand or be revoked, and fix a date which shall be not less than ten (10) days after the date of the action of the Council calling the election. The Mayor shall publish a notice of the call of such election in not less than one issue of a newspaper having a general circulation in the City of Portland, Arkansas, and posting in five (5) public places in the City of Portland, Arkansas not less than five (5) days prior to the date of election. Such notice shall designate by its number, caption, and date of passage, the ordinance which has been referred to the people for approval or rejection by their vote at such election. Otherwise, subject to the provisions of Article 5, Section 1 of the Constitution of Arkansas, and other applicable laws, said election shall be conducted in the manner provided by law for the conduct of a regular municipal election.

SECTION 8: That if any ordinance or resolution referred to the people is defeated at the polls, the Council shall make note of such a fact and shall expunge the ordinance or resolution from its files by erasing the same with red ink.

SECTION 9: That if any provision of this ordinance is held to be void, it shall not affect the validity of the remainder of the ordinance and the remainder shall stand.

SECTION10: That all ordinances and resolutions or parts thereof in conflict herewith are hereby repealed.

SECTION 11: The Council hereby ascertains and declares that uncertainty exists with respect to the time within which and the manner in which the right of referendum may be exercised by the electors of the City of Portland, Arkansas and in regard to the time when ordinances and resolutions of the City of Portland, Arkansas which affect the public welfare become effective. It is, therefore, declared that an emergency exists and this ordinance being nessary for the preservation of the public peace, health and safety shall take effect and be in force immedialty from and after its passage.
