Crossett Council Gets Update on West Crossett Lawsuit

An update on the pending lawsuit filed by seven West Crossett residents against Georgia-Pacific Corporation and the city of Crossett was discussed during Crossett's City Council Monday night, October 15.

City Attorney James Hamilton passed out copies of the Arkansas Supreme Court's October 11 opinion reversing the limited class-action certification granted by Ashley County Circuit Judge Bynum Gibson last October. Hamilton said that seven West Crossett residents acting as representatives filed the lawsuit against Georgia-Pacific and the city of Crossett, but that a ruling by Judge Gibson set abeyance the action against the city until claims against G-P were settled.

"If the class action had not been completely dismissed, it (the abeyance ruling) was the next best thing for the city," he said. "Frankly, we sit back, everything else gets litigated and if we have to, we step in and they have separate trials for us."

In addition to the abeyance order, Gibson also certified that it be tried as a private nuisance and property damage claim, he said. Although the private nuisance claim was a limited win for the plaintiffs, Hamilton said that G-P appealed Gibson's limited class-action ruling which was reversed and remanded.

"They said that there could not be a class-action in that type of case," he said. "They further said that there would have to be individual lawsuits and individual trials."

Hamilton said although he did not know what the outcome of the pending lawsuit would mean for the city that there was the prospect of 300 separate lawsuits against the city.

"Not just one lawsuit, but now 300 potential cases with the risks that go along with that," he said.

Hamilton explained to the council that although there are seven plaintiffs named in the filing that their attorney had asserted to the court that he had signed up over 300 property owners in the area.

"In the words of a great philosopher, I don't know," Hamilton said in reference to what the bottom line would be for the city.

In other business, Alderman Sue Miller said that she had received several complaints of cars being parked and sold in the parking lot across from Brookshire's. Mayor Scott McCormick said that the situation was something the council may address in the future, but in the past, in similar situations, when the vehicles are owned by several individuals and not one individual that the city was limited in the action it could take.

Suggesting the passing of a city ordinance, McCormick said that the city was faced with a similar situation at Gammel's Warehouse. Cars are being parked and sold by individuals, he said, adding that the only action the city could take was to ask the owners to move the vehicles to avoid obstructing traffic.

In old business, the mayor said he had not spoken to Alderman Candace Jeffress concerning progress on the dog ordinance, but hoped there would be something to present at the next council meeting. Also, he said, work is continuing on the business part for the proposed garbage rates and he hopes to have something to present the council in the near future.

John Mount, member of the historical society, said he wanted to thank everyone who assisted in the Wiggins Cabin Festival.

All members except Jeffress were present.

Hospital Tax Loses by 17 Votes

The Ashley County Medical Center's proposal to levy an additional one-fourth percent sales tax for maintenance of the hospital building and to finance new equipment lost by a margin of 17 votes in a special election on Tuesday, December 11. The proposal received a total of 748 favorable votes as compared to 765 that voted against it in the complete but unofficial results.

Arson Suspected in Fire that Destroys Home Under Construction

The Arkansas State Police and the Ashley County Sheriff's Department are conducting an investigation into the cause of a residential fire at 117 Ashley Road 292 last week. They are treating the fire, about three miles east of Hamburg, as possibly due to arson.

G-P Closes One Plywood Mill; 300 Employees Are Laid Off

Enrollment Declines in Ten of 13 School Districts in Cooperative Area

The enrollment in ten of the 13 school districts in the Southeast Arkansas Education Cooperative's service area has declined by 401 students over the past year, according to an e-mail from Norman Hill of the cooperative. The cooperative serves 13 districts in the region.

Most of Work Completed on New Roof for Courthouse

With the largest part of construction complete on the courthouse roof, Ashley County Judge Emory Austin discussed upcoming repairs to the ceiling on the second floor and gave an update on the construction progress Monday morning. During construction, Austin said leaks continued as workers with Dunn Construction installed the new hipped roof, but that the majority of damage was minor and anticipated.
